These terms & conditions (“Terms”) govern the registration and participation in Teacher Training programmes & continuing professional development courses (“Courses”), provided by SHP Health Ltd (“Company”)
Additional definitions apply:
“Participant” means any person that has registered and/or enrolled on any of the Courses delivered by the Company
“Tutor” means any individual who is employed by the Company to deliver education and training
By enrolling on Company Courses, the Participant agrees to be bound by these Terms.
The Company reserves the right to vary and revoke the Terms from time to time, which variation it may consider necessary or desirable for the regulation of the affairs of the education, training and conduct of Participants. Participants will be notified of any such changes and, until revoked, are and will be binding for Participants
References in the Terms to the plural will include the singular and vice versa
Please do not use our services or Website if you disagree with these Terms
By enrolling in a Course, the Participant acknowledges that they have read, understood, and agree to abide by these Terms
2. About our courses
SHP Health Ltd provides online, in-person and hybrid (online and in-person) education and training for individuals and groups including healthcare professionals, exercise practitioners and the public
Our teacher training programmes include (but not limited to):
SHP Dynamic Pilates Foundation Training (in-person & online or online only)
SHP Dynamic Pilates CPD course for Pilates Instructors (in-person & online or online only)
For successful completion of a course, all necessary criteria must be met and may include some or all of:
All required face-to-face training sessions must be attended in full
All required online lessons/topics/quizzes must be completed as stipulated
Final assessments (including practical/oral examinations or online assessments) must be completed in line with grade and marking criteria requirements
All course fees must be paid in full
Participants will have one year to successfully complete an individual Course (unless stipulated otherwise). Extension to this period will be at the discretion of the Company and the Company is under no obligation to grant such requests
3. Health & wellbeing
Participants need to ensure that they are medically fit to undertake strenuous physical activity and should seek medical advice if they have concerns over their physical condition or medical status. The Company reserves the right to refuse Course access to any Participant if, in its absolute discretion, it considers that the Participant may come to harm or be endangered by participation in a Course or Company Courses
Participants must inform Course Tutors if they have any underlying medical conditions or if they incur any injuries as part of or during a Course
Participants must always follow Tutor guidance and instructions, to ensure safe practice
Advice provided by Course Tutors at SHP does not constitute medical advice and is not a substitute for advice from a medical professional
For face-to-face Courses:
No pets (excluding guide dogs), crockery, glass or food are permitted in The Studio
Participants must familiarise themselves with fire exits, which are clearly marked, and in the event of a fire, must make their way to the nearest available fire exit
Smoking and alcohol consumption are forbidden on all SHP premises
4. Registration, enrolment and payment
Registration on the Website (shphealth.co.uk/courses) is an essential requirement as part of enrolling on/purchasing and then accessing any Courses. You will be required to provide a valid Email Address, First Name, Last Name, Street Address, Phone number and will then be directed to create a Password
Enrolment onto a Course is confirmed on receipt of any specific registration requirements and full payment or deposit as specified by the Company
Payment is typically made using the Stripe payment portal embedded within the WooCommerce payment gateway or the LearnDash course pages on the Company WordPress Website. VISA and Mastercard are accepted
Where staged payment plans are offered, all staged payments must be paid as stipulated
Late payments may incur additional fees or result in the forfeiture of the Participant’s place on a Course
5. Cancellation and refund policy
The Company offers limited refunds for Participants who cancel prior to or during a Course
The Company will refund 100% of a Course fee (less a £35 administration fee) if The Company receives written notification of cancellation request within 14 days of purchase
No refunds will be provided for cancellations made within 1 week before a face-to-face component of a Course starts or once a Course has commenced
The Company will allow you to transfer any monies paid by you to another Course for which you qualify, if the Course is scheduled to commence within one year of your initial enrolment/purchase. If you fail to transfer as stipulated above, the Company will have no refund obligation for any monies paid to us by you, regardless of when you cancelled or requested a transfer. The Company will allow only one such transfer
We reserve the right to cancel any course. If a course is cancelled and a replacement is not offered, we will refund all monies paid by you to us
In the event of travel restrictions outside of the Company’s control because of pandemic, natural disaster, or anything beyond the Company’s control, the Company reserves the right to deliver online live learning where possible, without refund or option for deferral
6. Attendance and participation
Where applicable, Participants are required to attend all scheduled in-person or online workshops, classes or stipulated compulsory sessions
In case of absence due to illness or emergency, Participants must notify the Company as soon as possible. Bespoke catch-up sessions may be arranged at the discretion of the Company and may incur additional fees
7. Certification
Active participation and completion of all assignments, exams, and practical/oral assessments are mandatory to receive certification
Certification is awarded upon successful completion of a Course, which includes attendance, participation, and passing all assessments
The Company reserves the right to withhold certification if the Participant fails to meet the Course requirements
8. Code of conduct
Participants are expected to maintain a professional and respectful demeanour throughout the Course
Any form of harassment, discrimination, or disruptive behaviour will not be tolerated and may result in expulsion from the Course without refund
9. Liability & limitations of liability
The Company is not liable for any injury, loss, or damage suffered by the Participant during the Course or when using SHP equipment, resources (including online material) or facilities unless such injury, loss, or damage is caused by the Company’s gross negligence
Participants are responsible for their own health and safety and should consult with a healthcare provider before participating if they have any concerns
Once Participants have completed a Course and gained certification, they are responsible for gaining necessary insurances to practice and for working within their scope of practice
Places on Courses are subject to availability and SHP reserves the right to cancel, reschedule or relocate a Course within a reasonable time frame, and will not be held liable for any expenses or loss of earnings because of such changes
Loss of earnings, accommodation and travel expenses from attending SHP Courses is the full responsibility of the Participant and the Company accepts no liability for these costs
SHP cannot be held responsible for cancellations that are the result of circumstances outside of the Company’s control (for example, strike action, travel disruptions and the weather). In such circumstances, SHP will make reasonable efforts to respond to such circumstances, to achieve a satisfactory resolution
Unless otherwise specified, any Course materials or resources are designed to assist SHP trained instructors to deliver Pilates classes for clients. Course materials or resources are in no way intended or sufficient for any Participant to subsequently train other people
It is the sole responsibility of the Participant to provide notice to the Company of any change of contact details (including email address), and all communications will be assumed to have been received by the Participant within 5 working days
10. Intellectual property
All materials provided during the Course are the intellectual property of the Company and are for personal use only
Participants may not reproduce, distribute, or share Course materials, in any format, without the Company’s prior written consent
11. Personal belongings
Personal belongings are brought onto SHP premises at the Participants own risk and the Company does not accept liability for any damage to or loss of such belongings
Vehicles parked on the Denbies Wine Estate site are parked at the Participants own risk and the Company does not accept liability for any damage to, or loss from or of, such vehicle
12. Privacy
The Company will collect and store personal information provided by Participants for the purpose of administering the Course
The Company will not share personal information with third parties without the Participant’s consent, except as required by law
Unless specified in writing by the Participant, the Company will communicate with the Participant by email. By providing an email address the Participant consents to email communications from the Company, including notices pursuant to the Terms. The Participant accepts that email may not be a secure and confidential means of communication, and the Company does not accept liability for any loss or damage caused by communication with a Participant via email.
